These Terms of Service ("Terms") govern your use of Tovu's website and services, operated by BrandAid, Inc. ("Tovu," "we," "us," or "our"). By accessing tovuai.com or engaging our services, you agree to these Terms.
Tovu provides AI-powered phone attendant services for independent insurance agencies, including setup, configuration, and ongoing operation of AI voice agents ("Services"). Service details, pricing, and scope are confirmed in writing prior to commencement of work.
You may cancel your monthly subscription at any time by written notice to [email protected]. Cancellation takes effect at the end of the current billing month, and that month is your last bill. The setup fee is non-refundable once build work has commenced. Monthly fees are non-refundable for the current billing period.

Tovu provides AI-powered voice agents. You are responsible for ensuring compliance with any applicable disclosure requirements in your jurisdiction regarding the use of automated or AI voice systems in customer-facing communications.
To the maximum extent permitted by law, Tovu and BrandAid, Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from use of our services, including but not limited to lost revenue, missed calls, or business interruption. Our total liability for any claim shall not exceed the fees paid in the 30 days preceding the claim.
We strive for high availability but do not guarantee uninterrupted service. Downtime due to third-party infrastructure (including Vapi, telephony providers, or internet outages) is outside our control and does not constitute a breach of these Terms.
All website content, brand assets, and proprietary systems developed by Tovu / BrandAid, Inc. remain our intellectual property. Custom configurations built for your agency remain yours upon full payment.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Polk County, Florida.
We may update these Terms at any time. Continued use of our services after changes constitutes acceptance. Material changes will be communicated via email.
Tovu / BrandAid, Inc. sends SMS/text messages only with express consent, obtained either by checking the optional SMS checkbox on a form on our website, or by verbally agreeing during a phone call after being asked directly. Providing a phone number does not by itself constitute SMS consent, and consent to receive text messages is never a condition of purchasing any goods or services. Messages may include appointment confirmations, reminders, follow-up communications, and service-related notifications. Message frequency varies based on your interactions with us. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and reply HELP for assistance. Wireless carriers are not liable for delayed or undelivered messages. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
